By using the Fitness Pledge app, you agree to be bound by these Terms of Use, as well as our Privacy Policy and any other policies or guidelines that may be implemented by Fitness Pledge LTD.
These terms form a legally binding agreement between you, the user, and Fitness Pledge LTD. If you do not agree to these terms, you must discontinue the use of the app immediately.
Continued use of the app following any updates to the Terms of Use constitutes your acceptance of the revised terms.
2. Eligibility
The Fitness Pledge app is only available to individuals who are 18years of age or older. By creating an account, you confirm that you meet this age requirement. Fitness Pledge LTD reserves the right to request proof of age and may terminate your account if you are found to be underage.
3. User Conduct
Users agree to use the app in a lawful and responsible manner. You are prohibited from engaging in the following activities: Providing false, misleading, or fraudulent information, particularly when submitting verification for fitness goals; Harassing, threatening, or abusing other users;Uploading or sharing content that is offensive, inappropriate, or in violation of any law or third-party rights; Attempting to interfere with the app’s operations, security, or performance; Using the app for any commercial purpose without the express permission of Fitness Pledge LTD.
4. Account Registration and Security
To use certain features of the app, you will be required to register and create an account. When registering, you agree to: Provide accurate and complete information; Maintain the confidentiality of your login credentials; Not share your account details with others. You are responsible for all activities that occur under your account. If you suspect unauthorised access to your account, you must notify us immediately. Fitness Pledge LTD is not liable for any damages resulting from unauthorised account use.
5. Use of App Content
All content provided through the Fitness Pledge app, including but not limited to workout plans, videos, nutritional advice, and coaching materials, is for your personal, non-commercial use only.
You are prohibited from: Reproducing, distributing, modifying, or creating derivative works of the app’s content without prior written consent from Fitness Pledge LTD; Using the content for any commercial purposes or making it available to third parties without authorization.
6. Subscription and Cancellation Terms
Fitness Pledge LTD offers subscription-based services that grant users access to exclusive content and coaching programs.
By subscribing, you agree to the following: Subscriptions will automatically renew at the end of each term unless canceled. You can cancel your subscription at any time through the app settings or by contacting customer support.
If you cancel your subscription, you will retain access to paid content until the end of the subscription period. After the subscription expires, access to such content will be revoked unless you resubscribe. Refund requests should be directed to support@fitnesspledge.io.
7. Pledges
As part of Fitness Pledge’s accountability service, Users can pledge money, at their discretion, towards a charity to support in accountability of their fitness goals.
You agree to the following terms: Pledged amounts must be based on realistic and verifiable fitness goals, which Fitness Pledge LTD will ensure is viable at the point of entering the goal. You are responsible for providing accurate, timely, and verifiable evidence of your progress toward achieving your fitness goals by the deadline specified at the time of the pledge.
Upon successful verification, when Users are completing their Pledge, Fitness Pledge LTD will not request any charge on completion. If Users fail to achieve their goal, the pledged amount will be requested and donated to the charity of their choice as indicated during the pledge process.
Users will have 30 days from the date of any failed Pledge to request no charge, if they no longer wish to provide that money as a donation towards their elected charity. This will be refunded immediately after it has been processed. To request the refund, the User must contact Fitness Pledge Ltd via info@fitnesspledge.io.
8. Modification of Services
Fitness Pledge LTD reserves the right to modify, update, or discontinue any features or services provided by the app at any time, without prior notice. While we strive to provide continuous access to our services, we cannot guarantee uninterrupted availability. Fitness Pledge LTD shall not beheld liable for any service interruptions, delays, or technical issues that may arise.
9. Collection and Use of Personal Data
By using the Fitness Pledge app, you agree to the collection and use of your personal data as outlined in our Privacy Policy. Fitness Pledge LTD collects personal data, including health-related information, to provide personalized services.
Users acknowledge that while Fitness Pledge LTD takes appropriate measures to secure data, Fitness Pledge LTD cannot guarantee the absolute security of user data. For more information on how your data is collected, used, and protected, please refer to our Privacy Policy.
10. Compliance with Laws
You agree to comply with all applicable local, national, and international laws and regulations when using the app. Any legal disputes arising out of or related to your use of the app will be governed by the laws of England & Wales.
11. Availability of Services
Fitness Pledge LTD aims to ensure that the app is available to users at all times. However, we cannot guarantee uninterrupted service, and the app may experience downtime for maintenance, updates, or other unforeseen issues. Fitness Pledge LTD is not liable for any disruptions, data loss, or inability to access the app.
12. Changes to Terms
Fitness Pledge LTD reserves the right to update or modify these Terms of Use at any time. Users will be notified of significant changes, and your continued use of the app after such changes signifies your acceptance of the revised terms. If you do not agree with the updated terms, you should discontinue use of the app.
13. Dispute Resolution
In the event of any disputes or claims related to these Terms of Use, both parties agree to attempt informal resolution. If a resolution cannot be reached, the dispute will be governed by the laws of England & Wales, and any legal action will take place in the courts of England &Wales.
14. User Interactions and Behavior
Users are prohibited from engaging in abusive, offensive, or harmfulbehavior, including harassment, discrimination, or inappropriate conduct towardother users or Fitness Pledge LTD staff. Fitness Pledge LTD reserves the rightto suspend or terminate accounts for violations of this policy.
15.Third-Party Services
The Fitness Pledge app may contain links to or integrate with third-party services. Fitness Pledge LTD is not responsible for the practices, availability, or content of any third-party websites or services. By using these links, you agree to review and abide by the respective third-party terms and privacy policies.
16. Intellectual Property Rights
All intellectual property associated with the Fitness Pledge app, including but not limited to trademarks, logos, workout plans, coaching materials, and software, is owned by Fitness Pledge LTD or its licensors. You agree not to reproduce, distribute, or create derivative works of this content without express permission.
17. Termination of Accounts
Fitness Pledge LTD reserves the right to terminate or suspend user accounts at any time for violations of these Terms of Use, such as providing false information, engaging in prohibited conduct, or misuse of theapp’s services. Users whose accounts are terminated for violations will not be entitled to refunds or reinstatement of services.
18. App Updates and Modifications
Fitness Pledge LTD may periodically update or modify the app to improve user experience, fix bugs, or introduce new features. These updates may occur automatically and without prior notice. Users agree to accept such updates and modifications as part of their ongoing use of the app.
19. User Feedback
By agreeing to these Terms of Use, you agree to allowFitness Pledge LTD to occasionally contact you for feedback on Fitness Pledge in order to improve our platform based on feedback. There is no obligation from the users to respond or provide feedback on receipt of outreach.
